A Holistic and Multidimensional Approach

Inter-State Water Dispute

Sec. 497 of IPC

A topic like Sec.497 of IPC could be a subject in the group discussion or asked in the interview. Sec.497 of IPC allows a husband to prosecute a person who committed adultery (sexual intercourse) with his wife, and he could even file a divorce case on the prima facie. However, such right was not given to the wife to prosecute the woman who committed adultery with her husband. More importantly, the section did not empower the wife to take action against the husband for infidelity. The second perspective is that if the copulation occurs between a man and spinster woman with her consent or with a married woman with her husband’s permission, then the man could not be accused of deceitfulness. 

The legality of Sec.497 of IPC was challenged in the Supreme Court by petitioner Joseph Shine. The bench headed by then Chief Justice of India Deepak Misra declared the section unconstitutional and was void. 

The court viewed the section as based on gender inequality, violating Articles 14 and 15 of the
Indian Constitution. The court also observed adultery could be termed as a criminal offense if one of the spouses commits suicide in events. The living spouse would be accused of abatement to suicide u/s 306 of IPC in such a situation. The judgment was hailed across the society, and many women activists viewed it as instrumental to ending patriarchal control.
